Se dico HACCP tutti ormai sappiamo di che si parla.
Ma ne siamo sicuri?
La risposta è no. Almeno, questo è emerso da una discussione sfociata all’interno dell’OCCCA CLUB, dopo che un iscritto ha chiesto se il corso di formazione dell’HACCP fosse obbligatoriamente a carico del datore di lavoro.
Secondo una buona parte, il datore è obbligato a pagare il corso, per poi diventare di fatto proprietario dell’attestato. Nel momento in cui si dovesse interrompere il contratto di lavoro, sarebbe quindi possibile per lui trattenere l’attestato HACCP del dipendente.
Dall’altra parte della discussione c’era chi sosteneva che invece essendo il corso di natura personale, ovvero non legato al sistema di produzione dell’attività ristorativa, la proprietà dell’attestato è del dipendente, il quale indipendentemente dal luogo di lavoro dovrà attenersi sempre alle regole di base (che ricordiamo sono di natura comunitaria europea) e il costo del corso non è obbligatoriamente a carico del datore.
All’interno di questo argomento c’è innanzitutto la necessità di distinguere il corso HACCP da quello che è il manuale per l’autocontrollo alimentare e procedure relative alla sicurezza dell’igiene, entrambe a carico del datore di lavoro il quale ha l’obbligo di provvedere a tutti i controlli necessari per garantire la salubrità del prodotto.
Nonostante abbia provato a chiedere maggiori delucidazioni ad enti competenti, sindacati e legali non sono riuscito a determinare in assoluto tra chi avesse torto o ragione.
Secondo il legale di un sindacato (ma su questo continuerà l’approfondimento nei prossimi giorni) ogni regione può legiferare differentemente su questo aspetto, motivo per cui ci sarebbero:
– regioni in cui il costo è obbligatoriamente a carico del datore
– regioni in cui il costo NON è obbligatoriamente a carico del datore
– regioni in cui addirittura sembra che il costo sia ripartito al 50% tra datore e dipendente.
Al contempo c’è chi smentisce completamente tutto (nella fattispecie una consulente che organizza i suddetti corsi, la quale nega che in qualsiasi regione sia obbligatorio per il datore pagare per il dipendente)
Andando a ricercare maggiori informazioni sul tema quello che è emerso con certezza però, sono altri aspetti, a mio avviso ancora più confusionari e soprattutto più pragmatici, ovvero la durata di validità del corso.
Si perchè mentre il costo è dopotutto una questione relativamente irrisoria dal punto di vista economico (tra le 50 e le 100 euro), altra faccenda più spigolosa e che può comportare disguidi più pratici è la scadenza dell’attestato, che è differente per ogni regione.
Volete un esempio?
– In Toscana il corso ha validità per 5 anni
– In Umbria per 3 anni
– In Sardegna per 2 anni.
Poniamo che un cameriere che lavora a Firenze abbia fatto il corso dell’HACCP nel corso del 2014. Finito il corso gli verrà riferito che il suo attestato avrà validità per 5 anni.
Lo stesso ragazzo però si licenzia a Marzo del 2017 e decide di partire per una stagione estiva in Sardegna.
Ovviamente quando gli verrà chiesto se è in possesso dell’HACCP, lui risponderà affermativamente. Peccato però che il suo corso, avvenuto nel 2014 sarà scaduto per la regione Sardegna dove la validità è di 2 anni.
Qualcuno potrà giustamente sostenere che durante il corso di formazione viene specificato che ogni regione decide la durata di validità. Vero, ma dove è possibile trovare l’elenco di queste scadenze per ogni regione?
Oppure nel 2016 dobbiamo chiamare al telefono l’ufficio asl competente per regione per avere questa informazione?
Soprattutto ad oggi non abbiamo trovato alcuna risposta del perchè, per quale motivo, sia stata permessa questa differenziazione e in virtù di cosa ci sono regioni che decidono scadenze di 2 anni o 5.
Fintanto che la situazione sarà questa però, vorremmo perlomeno correre ai ripari e fare maggiore informazione, visto che non siamo riusciti a trovare un database nazionale che dica in ogni regione quanto dura la validità dell’HACCP, sapreste dirci nella vostra regione quale è il termine di scadenza entro il quale rinnovare il corso?
